This terms of service (hereinafter referred to as “Terms”) sets out the rules regarding the use of the HashMap Cloud Mining Service (hereinafter re-ferred to as “Service”) provided by HashMap Ltd. (hereinafter referred to as “HashMap”) and HashMap Website located at www.hashmap-mining.com (hereinafter referred to as “Website”) and its subdomains.

The following terms and conditions shall be applied on the relation be-tween HashMap and the visitors of the Website and/or consumers of the Service (hereinafter collectively referred to as “User/Users” and/or Miner/Miners).
The Terms set out the legal terms and conditions regarding the Service. Actual prices, commercial terms, campaigns, offers and any instructions, guidance and similar information regarding the Service are announced on the Website and such information may be changed from time to time. The information announced on the Website is an integral part of the Terms. If there is a conflict arises between the Terms and the instructions, guidance and similar information found on the Website, the Terms will prevail.
The terms and conditions within the Terms are binding for the Users. In order to visit the Website and benefit from the Service, visitors and con-sumers shall confirm and agree to the Terms. The Terms shall be effective as of the moment the visitors and consumers connect to the Website. The Users agree that they have read, understood, accepted and confirmed the complete content of this contract as of the moment they connect to the Website.

By using the Website and/or the Service, it shall be considered that you agree to the Terms, if you do not agree with any terms or conditions in the Terms, do not apply, order or get the Service, and also use or access the Website. If you refuse to accept the Terms, you will not be able to purchase the Service or to access your portal related to an existing Service.

HashMap reserves the right, at its sole discretion, to amend, change, modi-fy, alter, add or remove portions of the Terms, at any time. It is your re-sponsibility to check the Terms periodically for changes. Your continued use of the Website and/or the Service following the published updates to the Terms will mean that you accept and agree the changes. As long as you agree and comply with the Terms, HashMap grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website and the Service.

In the Terms:

  • "Cryptocurrency", "Cryptocurrencies" is a reference to the distributed, decentralized peer-to-peer digital currencies:
  • "Bitcoins" is a reference to a Cryptocurrency known as Bitcoin;
  • "Altcoins" is a reference to all Cryptocurrencies other than Bitcoin, such as Litecoin;
  • "Miners" are individuals who register to mine cryptocoins with a Cloud Machine. If a User successfully applies to administer a Cloud Machine, he or she will be a Miner;
  • "Mining Hardware" is the computer hardware owned by HashMap that is used to provide the Service and to mine Cryptocurrencies;
  • "Hashrate" or "Hash rate" is the mining power of the Mining Hardware used to mine Cryptocurrencies;
  • "Cloud Machine" is the processing power of the Service purchased by a Miner and administered by a Miner using the Website;
  • "Service" is HashMap's cloud hosted mining service, which enables individuals to remotely mine Cryptocurrencies for themselves using our Mining Hardware and the Website;
  • "Support" or "Customer Support" or "Helpdesk" is the technical support service of HashMap that is provided via email/ticket system, available in the HashMap knowledge base/FAQ where the Users/Miners can find an-swers to general questions and request assistance by submitting a re-quest;
  • "Dashboard" is the graphical user interface of the Service, with which the Miner interacts to perform all actions related to the Service;
  • "Website" is www.HashMap-mining.com and any apps, software, emails or other websites which we use to provide the services of HashMap-mining.com (which includes the Service);
  • "Payout" is the payment made from the User/Miner’s Balance to his/her private e-wallet. The User/Miner clicks the Payout button to start the Payout process and it takes at least 48 hours to transfer the desired amount from the User/Miner’s Balance to his/her private e-wallet. HashMap may change the process and the transfer time of Payouts at any time;
  • "Account" is your personal access to the Service;
  • "Balance" is your personal Account balance;
  • "Contract" is the access to a Cloud Machine of specific Hash rate;
  • "Contract Term" is the period of time for which a Miner has agreed to pay to administer a Cloud Machine.
  • "Hold" is the state an Account can be placed in that prevents the said Account to make any withdrawals, used as a security measure;
  • "Pre-order“ or “Pre Sale” or “PreSale” is a Contract with a start date in the future. The start date is set by the HashMap on its own discretion. The announced start date is an estimated date and may be the subject to change.
5.1 The Terms apply to any mining Users undertake by using the Service and the Website and they form a legal agreement between the Users and HashMap on the acceptance of Users’ application for an Account.

5.2 Users may only apply to register as a Miner if:

5.2.1. The User is an adult according to the laws of his/her domicile (In many countries, the legal age is 18 years old or over; and 21 in some coun-tries)

5.2.2. The use of the Website and the Service is lawful for Users.

5.3. The Users must not mine, buy, sell, exchange, hold, own or otherwise use or exploit Cryptocurrencies in any way which is prohibited by the laws or regulations which apply to themselves.
6.1. Actions with Cryptocurrencies carry inherent risks. Due to the fact that Cryptocurrencies are unregulated and decentralized, their value is not insured by any legal entities.

6.2. It is not possible for HashMap to state or guarantee how many Crypto-coin units (Bitcoins, Litecoins and/or any other cryptocurrency) will be mined by any miner and/or specific cloud machine.

6.3. The value of any Contract, any amount of any Cryptocurrency is sub-ject to change by HashMap due to a number of factors out of HashMap’s control. These factors include but are not limited to changes of mining difficulty and/or other mining parameters/properties, fluctuating price (in fiat currency to Cryptocurrency exchange rate, such as USD/BTC) of Crypto-currencies, obsolescence of hardware and amortization of hardware.

6.4. The Users must understand and agree that the worth of any Contract and any amount of mined Cryptocurrency may lose all worth at any mo-ment of time due to the nature of Cryptocurrencies. In this case, Users understand that they are solely responsible for management of the Crypto-currencies in their balance.

6.5. Any information related to Cryptocurrency and Cryptocurrency mining that is/was posted, published and/or provided by HashMap via any channel of communication (including but not limited to: on the Website, in the Dashboard, via the Support Service, via e-mail newsletter, in social media) is subject to change.

6.6 Cryptocurrencies may not be appropriate for everyone. Before mining any cryptocurrencies, the Users should learn about them to ensure that they are appropriate for themselves. Like all currencies, there are disadvantages to using Cryptocurrencies. Some of the risks particular to Cryptocurrencies include:

6.6.1. currency fluctuation - the price of Bitcoin and/or any other Cryptocurrency may fall sharply and may even fall to zero;

6.6.2. transactions with Cryptocurrencies may be unconfirmed for a period of time. Although very unlikely, some Cryptocurrency transactions may never be confirmed - Cryptocurrency transactions which are unconfirmed are not completed;

6.6.3. transactions with Cryptocurrencies are irreversible - if the User sends any amount of any Cryptocurrency to the wrong person, the User may be unable to recover those funds;

6.6.4. Cryptocurrencies may be lost if the User loses or forget any PINs or passwords necessary to access and spend those Cryptocurrencies;

6.6.5. unknown technical defects inherent in Cryptocurrencies; and

6.6.6. new regulation which impacts the use of Cryptocurrencies.

6.7. By agreeing to the Terms or by mining Cryptocurrencies by using the Service, the Users are indicating that they understand, are capable of understanding and accept the risks associated with the Cryptocurrencies, Mining, the Service and the Website.
The Terms is valid indefinitely, even after Account termination. The Contract Term for the Service is 24 (twenty-four) months. The Contract is valid and binding for the User until the expiration date, unless it is terminated by the HashMap.

Contracts with a stated expiry date will end on the date of expiry. Pre-order Contracts that are not activated immediately on purchase will activate on the announced date, unless it is changed by HashMap. HashMap reserves the right to change the launch date, Contract Term and/or Mining Term of any Contract.
8.1. The Users must submit personal information, such as a valid email address (that will be used as Username and for user identification) for Account, a password.

8.2. The Users must submit at least one wallet number and information to be able to withdraw funds. The Account may allow the Users to add more than one Cryptocurrency wallet.

8.3. The Users must ensure that all information given that is held by HashMap is true, complete, not misleading and up to date.

8.4. To register as a Miner, HashMap may require Users to provide identification or other documentation in order to help prevent fraud or money laundering. This may include photographic identification and a recent proof of address. HashMap may also undertake its own identity, fraud and credit checks.

8.5. It is forbidden for Miners to visit the Website or use the Service through anonymous proxies (such as Tor) and other services or technologies that hide the real internet connection of the Users.

8.6. By applying to register, the Users are making an offer to enter an agreement on the Terms. Once submitted, the Users may not withdraw their offer.

8.7. Only HashMap can decide whether applications will be accepted. If any application is accepted, a legal and enforceable agreement will be entered between the User and HashMap. Subject to any statutory rights the Users may have, the Users may not cancel the agreement covered by the Terms and the Users will not be eligible for any refund.
9.1. The Username and Password will be allocated to the Users if they successfully apply for registration as a Miner.

9.2. The Users will need their username and password to access some parts of the Website. Usernames and passwords are personal and they must not be disclosed to any other persons.

9.3. The number of accounts is limited to 1 for each beneficiary.

9.4. When the Users register, they may submit an order to administer a Cloud Machine. This order will allow them to specify the processing power of the Cloud Machine. Only HashMap can decide whether orders will be successful and acceptance is subject to availability, amongst other things.

9.5. An order is a request to acquire a Contract from HashMap and does not represent a formed contract. If HashMap accepts the User’s order, the order will be associated with the Users’ Contract and the Account. Until then, an order is considered pending and HashMap reserves the right to decline any payment.

9.6. Confirmation of an order will be made by email, which will also contain an estimated commencement date for the Contract. The confirmed commencement date of the Contract will be notified in a subsequent email. HashMap cannot say how long it will take to confirm the commencement date of the Contract. After the commencement date of the Contract, the Users are referred to as Miners.

9.7. Subject to the payment of any fees which may be applied, Miners will be able to receive Cryptocurrencies on the basis of the processing power of the Cloud Machine and the period of time for which the Cloud Machine is mining. Miners will only be able to administer the Cloud Machine during the Contract Term. Those Cryptocurrencies will be transferred to the Miners’ wallet upon request, if such request is confirmed.

9.8. If the Miners lose access to their Account, HashMap may ask from the Miners to provide certain types of data, including personally identifiable information, to determine ownership of the Account. This may include, but is not limited to: proof of identity; proof of residence; proof of telephone number/email ownership and any identifiable activity on the Website, such as transaction IDs, order numbers, withdrawal amounts and others.

9.9. The Miners may only mine Cryptocurrencies for their own benefit. By using the Website and/or the Service the Users/Miners confirm that they are not acting for the benefit of any other person or entity.

9.10. HashMap is entitled to assume that any use of the Account is solely made by the Miner. The Miners are solely responsible and liable for any use of the Website or the Service under their Account or any other use of their username and password.

9.11. HashMap is not responsible for hacked accounts or if the Miners give their password to any third party. The Miners must not share their passwords with any other person, allow any other person to use their account.

9.12. If there is any reason to assume that any other person knows the password, or that the Account has been used by any other person, HashMap shall be informed immediately. Otherwise, HashMap are not liable for any improper use of passwords or accounts, loss, damages or whatsoever thereto.

9.13. If the Miner does not log into his/her Account for 12 months, HashMap may terminate the Account. The Miner will be, if possible, notified in advance. If HashMap is unable to contact, or the Miner does not take any action to prevent account termination, his/her Balance will be nullified.
10.1. HashMap provides a platform which enables individuals to mine cryptocurrencies using Mining Hardware. In return, HashMap charges a Service fee (“hereinafter referred to as “Fees”) depending on the Contract which is chosen by the User/Miner between the offers provided by HashMap on the Website. The Fees must be paid by the User/Miner according to the payment plan set by HashMap and announced on the Website in order to start the chosen mining service.

10.2. Fees must be paid upfront before the Service by HashMap has been initiated. Unless otherwise provided by law or by a particular offer, all purchases are final and non-refundable. HashMap reserves the right to issue refunds at HashMap's sole discretion. If HashMap issues a refund, we are under no obligation to issue the same or similar refund in the future.

10.3. HashMap reserves the right to change the fees at any time without prior notice.

10.4. Any tax relating to the coins, revenues and monetary worth created by the User/Miner’s Mining activity shall be paid by the User/Miner within the period regulated under the legislation of the User/Miner. HashMap has no obligation to report, notify, keep records of or pay any tax arising from the User/Miner’s mining activity. In case of non-payment, any liability related thereto is incumbent on the User/Miner and any losses and damages to be incurred by HashMap in connection therewith shall be covered by the User/Miner.
11.1. Balance in the Dashboard is personal amount of funds available to use. Funds mined will be transmitted directly to the Miners’ balance. This may take up to 24 hours from the date and time the coins are generated.

11.2. The Service has one Cryptocurrency Balance:

11.2.1. BTC Balance is measured in BTC (Bitcoins), accurate to 0.00000001 BTC (1 satoshi, the minimum indivisible amount of BTC);

11.3. Balance can be used in the following ways:

11.3.1. The Miners are able to withdraw their balance at any time if it meets the minimum requirement, unless stated otherwise (subject to change).

11.3.2. The Miners are able to purchase additional Contract(s) for the Cloud Machine(s) to increase total Hashrate.

11.4. HashMap reserves the right to make retroactive recalculations to balance(s), Cloud Machines, Hash rate and logs, including but not limited to, in the case of any error occurring in the Service, to correct any mistakes or discrepancies.
12.1. All invoices are issued in Euro by default. Payments performed in any other currency must account for the exchange rate of said currency to EUR at the moment of invoice generation and any commissions for currency exchange.

12.2. A User is able to purchase a Contract using a variety of payment methods:

12.2.1. in Bitcoin via a Balance Purchase: purchase of hashrate using the Account Balance directly.

12.2.2. in Bitcoin via a Bitcoin Transfer: transfer of BTC to HashMap BTC account via CryptoPay payment system, the amount to pay depends on: sum of the order in USD, the USD/BTC exchange rate at the moment of the purchase and the transfer fee of the Bitcoin network (third-party terms and payment commission may apply);

12.2.3. in EUR via PayPal: (third-party terms and payment commission may apply);

12.2.4. in EUR via a Credit Card: (third-party terms and payment commission may apply).

12.2.5. in EUR via Bank wire transfer: (fees depending on bank)

12.3. In case of any return of overpaid funds and/or refunds, HashMap may charge a processing fee, depending on the payment system used. The amount of the processing fee is subject to change:

12.3.1. Bitcoin transfer: 0.005 BTC;

12.3.2. PayPal: not available;

12.3.3. Credit Card: not available;

12.3.4. Bank transfer: Depending on your bank.

12.4. The User has the right not to pay for the order in case the order has been created but not yet paid, if the User/Miner decides not to complete the order. The order will change status to "Timeout" after a given period of time (dependent on the payment method) and the User will not be obliged to proceed with the order. HashMap will not process requests to cancel unpaid orders, as it is intended the unpaid orders stay in "Timeout" status.

12.5. HashMap provides the destination account for all payment methods (except Balance and Reinvest purchases). In order to confirm the purchase and activate the Contract, the User is required to transfer the amount stated on the HashMap invoice page (for Wire transfers) or on the thirdparty payment page (all payment methods with third-party processing systems).

12.6. In case of any credit card purchase, HashMap has the right to place the User/Miner's Account on hold (hold the ability to withdraw any mined funds from the Account Balance) for a period of up to 30 days as a security measure of anti-fraud related regulations and policies.

12.7. The User/Miner is solely responsible for the accuracy of payment, including but not limited to: the destination account, transferable amount and payment details:

12.7.1. If the transferred amount is below requested, HashMap reserves the right, at its sole discretion, to adjust the Contract accordingly to receive funds or request the missing amount to be paid, before activating the Contract.

12.7.2. If the transferred amount is above requested, HashMap reserves the right, at its sole discretion, to adjust the Contract accordingly to received funds, add the excessive amount to the User/Miner’s Account Balance or return the excessive amount through the payment system the User has used to pay for the order initially.

12.7.3. If the User/Miner initiates the payment with incorrect/insufficient details and/or to the wrong destination account, HashMap will attempt, if possible, to process the order in a timely manner. If the destination address does not belong to HashMap (directly or via a third-party service) and/or is not related to HashMap in any way, HashMap will not be held responsible and will decline any claims.

12.8. In case of payment related issues a claim must be raised:

12.8.1. The User/Miner has the right to raise a payment related claim/dispute by contacting support within 14 days from the creation of payment with proof of payment. Requests submitted after 14 days may not be processed.

12.8.2. HashMap reserves the right to request proof of payment, if there are suspicions or facts the payment was not received but the Contract was activated. The User/Miner is obliged to provide proof of payment within 14 days of reception of such request.

12.8.3. Proof of payment includes but is not limited to: HashMap order number, unique transaction ID or number, destination account, transferred amount, account statement from the payment system used.

12.8.4. Credit Card purchases may require proof of ownership of the payment method and an identification request.

12.8.5. If proof of payment is not provided within 14 days or provided proof is deemed insufficient and/or invalid:

12.8.5.1. if the claim was initiated by a User: HashMap reserves the right to decline User/Miner's claim(s);

12.8.5.2. if the claim was initiated by HashMap: HashMap reserves the right to adjust/cancel related Contracts and adjust User/Miner’s Account Balance by amounts mined by related Contract.
13.1. During the Contract Term the Miners can use the Website to:

13.1.1. amend or update their registration and contact details;

13.1.2. with the help of customer support deactivate or reactivate their Account as well as terminate an active Contract;

13.1.3. with the help of customer support change the login email address;

13.1.4. change some parameters of the mining of their Cloud Machine; and

13.1.5. change their cryptocurrency-specific wallet addresses.

13.2. Subject to payment and additional Fees in advance, the Miners can use the Website to:

13.2.1. add a new Cloud Machine; and

13.2.2. increase the processing power of the Cloud Machine.
14.1. The Users and/or Miners agree to comply with all applicable constitutions, laws, ordinances, principles of common law, codes, regulations, statutes or treaties and all applicable orders, rulings, instructions, requirements, directives or requests of any courts, regulators or other governmental authorities (“Law”) in connection with the use of the Website and the Service.

14.2. The Users and/or Miners agree not to use the Service or the content or information delivered through the Service to conduct any business or activity or solicit the performance of any activity for any illegal, fraudulent, unauthorized or improper purpose.

14.3. The Users and/or Miners agree not to falsely describe or otherwise misrepresent themselves in any dealings with HashMap.

14.4. The Users and/or Miners agree, state and undertake not to abuse or harm the Service, the Website and any offers, campaigns, discounts provided from time to time by HashMap and/or its partners.

14.5. HashMap reserves the right to not to provide any information regarding its servers, contracts, employees, shareholders and shareholder structure, suppliers, facilities, internal and confidential information, trade secrets and databases. The Users and/or Miners agree to not to obtain and disclose that information unlawfully.

14.6. The Users and/or Miners are not allowed to use any means to mask their internet traffic and IP address (such as Proxy, Tor, VPN and others).

14.7. The Users and/or Miners are strictly forbidden to use or exploit errors in design of the Website, the Service and/or all and any of their parts, features which have not been documented, and/or "program bugs" for commercial/personal gain or as means to disrupt and/or destabilize the Service and/or the Website. The Users and/or Miners are strictly forbidden to use or exploit the mistakes or errors made by HashMap, its employees, agents, suppliers and partners. The Users and/or Miners are required to report their findings to HashMap, if they encounter such an error or mistake.

14.8. If HashMap has reason to believe that any User and/or Miner or any entity under their common ownership or control have engaged in any of the prohibited or unauthorized activities described in the Terms, have otherwise breached obligations under the Terms, have misappropriated HashMap’s trade secrets or confidential information, copyrights, patents or other intellectual property rights, then without demand or prior notice and without limiting any of its other available remedies, HashMap may:

14.8.1. terminate, suspend or limit the User/Miner’s access to or use of their Account or the Service;

14.8.2. terminate or suspend this Agreement or any Service;

14.8.3. withhold distribution of any user service or right;

14.8.4. notify law enforcement, regulatory authorities, impacted third parties and others as we deem appropriate;

14.8.5. refuse to provide the Service to the User/Miner in the future;

14.8.6. take legal action against the User/Miner.

14.9. The Users/Miners agree not to use the Website or the Service in any way which is unlawful and may give rise to civil or criminal liability for HashMap or may bring HashMap into disrepute.

14.10. The Users/Miners hereby agree to indemnify, defend and hold HashMap and its officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") harmless from and against any and all liability and costs (including reasonable legal fees) incurred by the Indemnified Parties in connection with any claim arising out of:

14.10.1. any fraud or fraudulent misrepresentation the User/Miner commits;

14.10.2. any inaccuracy or defect of any of the information the User/Miner has provided to us;

14.10.3. any breach of applicable law or regulation the User/Miner commits;

14.10.4. any other person’s use of the Account;

14.10.5. any breach by the User/Miner of these Terms; and

14.10.6. third party claims arising from the Users/Miners’ use of the Website or the Service, any of the Users/Miners’ content or any use of the Account.

14.11. The User/Miner shall cooperate with HashMap in the defense of any claim. HashMap reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User/Miner.
15.1. HashMap provides and maintains the Website and the Service on an "as is" and "as available" basis and HashMap is liable only to provide the Service with reasonable skill and care.

15.2. HashMap gives no other warranty in connection with the Website or the Service and HashMap disclaims all liability for:

15.2.1. to the extent allowed by these Terms and without affecting any other clauses, that may apply, accuracy, currency or validity of information and material contained within and/or provided by the Website, the Dashboard, the Support Service, in email newsletters and social media. The User/Miner hereby agrees, that no radio, computer and internet communication equipment is completely free of fault, occasional technical disruptions may affect the service and so can human error, which may result in misrepresentation of content or miscommunication;

15.2.2. any change in the exchange rate of Bitcoins or any other Cryptocurrency; the acts or omissions of any bank or provider of banking services;

15.2.3. any change in the difficulty of mining;

15.2.4. any changes in applicable law or regulation, or the acts of any legislator or regulator in any part of the world, including but not limited to changes to the regulatory, legislative or technical environment applicable to Cryptocurrencies;

15.2.5. any interruptions to or error of the Website or the Service or other communications network;

15.2.6. the infringement by any other person of any copyright or other intellectual property rights of any third party through any User Content or use of the Website or the Service;

15.2.7. the availability, quality, content or nature of any external website;

15.2.8. any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by any other person accessing, using or downloading the Website, the Service or any user content; and

15.2.9. all representations, warranties, conditions and other terms and conditions which, but for this notice, would have effect; HashMap will not be liable in any amount for failure to perform any obligation under these terms of service if that failure is caused by the occurrence of an event beyond HashMap’s reasonable control.

15.3. Except as provided above there are no other warranties, conditions or other terms and conditions, express or implied, statutory or otherwise, and all of those terms and conditions are hereby excluded to the maximum extent permitted by law.

15.4. To the maximum extent permitted by law, HashMap excludes liability for any losses or damages which the User/Miner may suffer, whether the same are suffered directly or indirectly or are immediate or consequential, which fall within any of the following categories:

15.4.1. special damage even though that party was aware of the circumstances in which such special damage could arise;

15.4.2. loss of anticipated savings, business opportunity and management time;

15.4.3. loss of goodwill;

15.4.4. loss of Cryptocurrency arising as a result of any of the User/Miner’s acts or omissions of those of any third party;

15.4.5. loss arising out of or in connection with any defect or insecurity in any systems the User/Miner uses to store or transmit Cryptocurrency or to access or use the Website or the Service; any inaccurate or incomplete information the User/Miner provides, including Cryptocurrency wallet addresses.

15.5. The User/Miner accepts and states that HashMap has no liability regarding any errors, mistakes, misconduct, misbehavior and fraudulent activity of any agency, sales person, intermediary, bank, payment and collection agent.

15.6. To the maximum extent permitted by law, HashMap’s aggregate liability in respect of any claims made in connection with or arising out of the use of the Website or the Service (whether in contract, tort (including negligence), breach of statutory duty, or otherwise) for direct losses will be limited to the Fees.
16.1. Without limiting any other rights HashMap has, HashMap may suspend or terminate access of the User/Miner to the Account, the Website and/or the Service, nullify the Account Balance and/or hold the ability to withdraw mined funds if the User/Miner breaches any of these Terms.

16.2. If HashMap has grounds to suspect that the User/Miner is using the Website or the Service fraudulently or improperly, HashMap will suspend the User/Miner's Account until he or she is able to demonstrate to HashMap's satisfaction his or her identity and that no fraud or impropriety has occurred or been attempted.

16.3. HashMap will give reasonable notice of any anticipated termination of the Website or the Service.
17.1 All questions, comments or complaints should be directed via the means provided at the Website.

17.2. HashMap will communicate with the User/Miner at the email address provided or through other means of communication that may be provided by the Website.

17.3. Notices that are applicable to all Users/Miners will be available on the Website publicly.

17.4. The Users/Miners will be deemed to have received a notice at the time the email is sent or the time the notice is posted on the Website.

17.5. HashMap will be deemed to have received a notice when we issue a confirmation to the User/Miner.

17.6. All emails (or other messages) HashMap send are intended for the addressee only.
18.1 This Website and the Dashboard are presented in English and German. In the case of a conflict between translations, German version will prevail.

18.2. These Terms, together with the instructions, guidance and similar information found on the Website (from time to time), constitute the entire agreement between the User/Miner and HashMap relating to the use of the Website and the Service.

18.3. HashMap’s failure to enforce any term does not constitute its waiver of that term.

18.4. If any part of these Terms is found to be unenforceable, it will be amended to the minimum extent necessary to make it enforceable and the remainder of the provisions will remain in full force and effect.

18.5. Any of these Terms which by their nature should survive will survive the termination of the Terms.

18.6. The Parties shall make their best efforts in order to settle the disputes which may arise between them through mutual negotiations on the basis of goodwill Valletta Courts and Execution Offices shall be competent in settlement of disputes between the Parties arising from this Agreement.

18.7. The laws of Malta will govern any disputes relating to the Service or these Terms, notwithstanding the conflicts of laws rules.

18.8. HashMap will be entitled to assign the agreement or any rights and obligations under these Terms or the Service to a third party by giving reasonable notice, which may include notice given via the Website.

18.9. The User/Miner may not assign, transfer, sublease, encumber or subject to any security interest a Service without written authorization from HashMap. Any attempted assignment in violation of this Agreement will be void and of no effect. No other person, other than the registered User/ Miner, shall have any rights to enforce these Terms or a Service.
